CONSENT TO TERMS AND CONDITIONS
Access to and use of the services of Genie Ventures, LLC (d/b/a “Tonic Travels”, “Tonic”, “we”, or “our”) and our website is subject to acceptance of these terms and conditions (“Terms and Conditions”). By accessing or using any content, products, or services through our offices or website, you (“Customer” or “you/your”) agree to be bound by these terms. PLEASE READ THE TERMS AND CONDITIONS BEFORE USING THIS WEBSITE. If you do not accept all of these terms, then please do not use our services or our website. These Terms and Conditions govern the relationship between Tonic Travels and you. These terms restrict your rights and remedies and provide protection to Tonic Travels, including warranty disclaimers and liability exclusions. IF THERE IS ANY PART OF THESE TERMS AND CONDITIONS YOU DO NOT AGREE WITH, PLEASE DO NOT USE THIS WEBSITE OR TONIC TRAVELS’ SERVICES. No alterations to these terms and conditions may be made by any Tonic Travels employee, advisor, representative, or other person, unless in writing by an authorized officer of Tonic Travels.
Trip Requests
We have preferred partnerships all around the world that enable us to prepare unique and memorable vacations and incentive trips to just about any destination. Trip requests can be as detailed or minimal as you would like. We generally do not accept air only requests, unless they are for roundtrip, business class or higher fares. Requests for minor revisions to your program are encouraged and welcomed. We will make every effort to make the necessary revisions to your travels. We will accept one major revision request per program. A major revision is a complete change in destination, itinerary, or significant date change after trip planning has begun. Additional revisions may be subject to special handling fees.
Planning Fees
We reserve the right to charge a planning fee. This planning fee will be communicated and agreed upon prior to the start of trip planning. The amount of the planning fee is based on the complexity of the travel, including but not limited to destination, length of stay, dates of travel, level of daily travel planning, and whether or not your Travel Advisor receives compensation from our suppliers.
If you would like your Travel Advisor to build a custom, multiday itinerary or you would like your Travel Advisors to research various hotel options, you will be subject to a planning fee, which must be agreed upon before our travel planning commences. This planning fee will be agreed to verbally and in writing.
If at any time during the planning process, you decide to cancel or postpone the trip, this fee remains non-refundable. At no time will this planning fee be eligible for a refund.
Special Handling Fees
Bookings requested within 30 days of departure may incur special handling fees. Complex trips or multiple trip requests may incur special handling fees as well.
Deposit & Final Payment
Quote/option pricing is not guaranteed until we receive payment or credit card guarantee and the same is confirmed with the service provider, hotel, airline, or other travel provider. Certain products may have additional deposit requirements. Deposits may be refundable, partially refundable, or non-refundable, we will notify you of the policy at the time of the quotation or on your balance due invoice. If we do not receive final payment by the specified date, we reserve the right to cancel the reservation. In the case of billing errors, we reserve the right to re-invoice with correct pricing. Third party charge cards are not accepted without written authorization.
Cancellations & Cancellation Fees
All cancellations must be advised in writing. At the time of booking we will advise you of the cancellation policy of your hotel and/or program. If a cancellation policy has not been provided to you, you are to assume the booking is non-refundable. Cancellation policies vary and are implemented by the supplier. Please verify with your Travel Advisor if you have any questions on the cancellation policy. While you may feel some circumstances warrant leniency on cancellation penalties, it is not for us to make this decision. We always recommend travel insurance for this reason. We require the following cancellation fees, unless otherwise noted:
- $25 per hotel cancellation
- $100 per person, cancellation fee for a custom trip that has been deposited but not paid in full
- $200 per person, cancellation fee for a custom trip that has been paid in full
Passports & Visas & Travel Documents
It is your responsibility to obtain and carry a valid passport, a valid visa, and all other documents required by applicable government regulations. Your passport must be valid at least six months after your date of return to the U.S. The name on your reservation must match the name on your passport. Non-U.S. citizens must consult with the appropriate consulates to determine if any additional visas are needed. It is suggested that all passengers, regardless of the passport they hold, check with the appropriate consulates of the countries being visited to determine if any visas are needed. Securing any needed visas is the responsibility of the passenger. A sample of popular countries that currently require visas for United States citizens follow. Please note, there are additional countries that require visas that are not included in this list, and visa requirements may change at any time.

When travelling domestically or internationally, TSA and U.S. Department of Homeland Security advise that you carry at least two forms of acceptable identification to board a flight.
Children and infants also require all such travel documents. Minors traveling with one parent, or without both parents, may be stopped and not admitted to flights/countries, unless consent forms (authenticated and verified) and potentially other documentation are provided to the authorities. The U.S. Customs and Border Protection Agency has special requirements for USA child groups under age 19 and you are responsible for complying with such requirements. You acknowledge any failure to strictly comply with these or other governmental requirements may result in a denial ofbboarding or delay at an airport security checkpoint causing you to miss your flight(s) and subsequent travel bookings.
Entry and Exit Requirements
Each foreign country evaluates past criminal offenses differently, whether such occurred within or outside of their boundaries. If you have a current or past offense, please contact any countries that you are travelling to, or through, directly for entry and exit requirements. Even when a visa is issued, you may be denied entry since by that country, since each country’s local immigration officials make the final entry determination, including consideration of any past criminal record. Should a visa not be issued or honored, Tonic Travels is not responsible for lost payments made toward the travel reservations.
Program Prices
Program prices are per person, based on two persons sharing a room, unless otherwise stated. All prices are based on rates (including foreign exchange rates) known at the time of quotation. You are responsible for foreign exchange increases or decreases up until final payment is made. We reserve the right to recover from you any increase in airline-imposed fuel surcharges and taxes, charges or levies imposed by any government or its agencies, up to and including the first day of travel.
Itinerary Variations
If program improvements can be made or if unforeseen circumstances beyond our control make changes necessary, we reserve the right to vary itineraries and to substitute similar hotels.
Airfare
Airfare quoted by us or one of our Air Affiliates is only confirmed at the time of payment and when an E-ticket number has been generated. If you do not have an e-ticket number on your reservation, your ticket is not confirmed. Once an air ticket has been issued and a confirmation has been generated, any airline-imposed changes to seat assignments, departure and arrival locations/times, etc are not a result of any actions by us. However, we will make every effort to remedy the situation if you are not happy with the change. We do not work for any airline nor are we directly affiliated with any airline. Therefore, we cannot be held liable for any changes or complications caused by an airline. It is the passenger’s responsibility to confirm that all airline reservations are correct and include proper spelling of legal names at the time of confirmation. We understand that air travel can be frustrating at times. A benefit to booking your air travel through us is that we are available to advocate on your behalf if you incur airline changes, cancellations and other disruptions. Please remember that we only offer flight bookings as an additional service that supports your travel program.
Travel Insurance
Travel insurance is always recommended to protect you and your trip investment. There are a variety of policies available, depending on your needs and trip costs. Keep in mind there are numerous inclusions and omissions to travel insurance policies, and it is your responsibility to ensure your needs are met. If you have specific questions regarding your policy, please contact the insurance provider, and we can provide you with their contact details. Pre-existing condition clauses and supplier financial default clauses vary by policy and typically require you to purchase your insurance soon after deposit. Please notify us as soon as possible if you have any pre-existing conditions (please note, pregnancy also is considered a pre-existing condition.) We are not liable in cases of supplier, financial default but we will rely on our professional knowledge to recommend companies who we believe to be financially stable. Some insurance policies are eligible for “Cancel For Any Reason” insurance, which must be purchased within a certain timeframe of the base policy, often 15 or 21 days. Inquire with us if you are interested in this type of policy. Some insurance providers also offer medical only policy options. Travel insurance policies are typically limited in emergency evacuation coverage. Therefore, medical evacuation policies are also recommended. Unless specifically noted, travel insurance is not included in the quotes for your travel. Without appropriate travel insurance, you understand and agree that if you cancel or your travel gets interrupted for any reason, portions or all of the trip may not be refunded, and Tonic Travels’ and travel suppliers cancellation penalties will apply resulting in monetary loss. Employees of Tonic Travels are not qualified or authorized to: answer technical questions about benefits, exclusions, and conditions of any of the insurance offered, or evaluate the adequacy of your existing insurance coverage.
Risks, Safety, Force Majeure, Pandemics and Government Actions
Travel to certain destinations may involve greater risk than other destinations. Tonic Travels urges customers to be informed on current news regarding their countries in their trip and to review travel prohibitions, warnings, announcements and advisories issued by the United States Government and any other governments of countries in their trips, prior to booking travel to international destinations. The Smart Traveler Enrollment Program is a free service provided by the U.S. Government to U.S. citizens traveling to, or living in, a foreign country, and allows you to enter information about your trip abroad so that if there is an emergency, the Department of State can better assist you.
By offering for sale travel to particular destinations, Tonic Travels does not represent or warrant that such travel is advisable or without risk, and shall not be liable, including for any costs, damages, or losses, that may result from travel to such destinations. We are not liable for any losses incurred during these situations, such as in the case of a refund not being issued by a supplier during such time or times of extraordinary, unforeseen circumstances. Please note, traditional travel insurance policies do not cover pandemics or government actions, and you must purchase a “Cancel for Any Reason” add on to be covered for these extreme events.
“Force Majeure” means any circumstances beyond the reasonable control of Tonic Travels, (including, but without limitation, acts of God, explosion, flood, tempest, forceful wind, fire, accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, insurrection, riots, strikes, civil disturbance, requisition, sickness, quarantine, government intervention, weather conditions, defects in machinery and vehicles, delay, wildlife, or other such occurrences.
Tonic Travels shall not be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations (or its suppliers or travel provider’s obligations/services) hereunder to the extent that any such delay or non-performance is due to any Force Majeure. If Tonic Travels, or its travel suppliers, are affected by Force Majeure, they shall be entitled to, and may in their sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to your trip. Payment of any refund by Tonic Travels to you as a result of the non-performance of any obligations hereunder shall remain in its sole and absolute discretion of Tonic Travels. If any form of reimbursement is made, Tonic Travels shall be entitled to deduct from any refund the reasonable actual and potential costs to Tonic Travels of the Force Majeure and applicable cancellation fees.
Limitations and Disclosure
Tonic Travels acts solely as a booking agent for the supplier hotels, airlines, air charters, ground transportation, boat companies, and other independent contractors providing accommodations, transportation, and/or other services, and is not the source or provider of the travel services. Each of these supplier companies is an independent entity and is not subject to the control of Tonic Travels. You are advised that the suppliers whose names appear in travel documentation are those actually responsible for providing the travel services and consent to the use of those suppliers and understand and agree that each supplier will have its own Terms and Conditions as might be in printed form or on their websites, which govern the transaction. The transportation, accommodations and other services provided by the identified sea, ground, and air operator suppliers offered are subject to the terms and conditions contained in the tickets, exchange orders or vouchers issued by them and/or their suppliers, including Terms and Conditions on their respective websites.
Because Tonic Travels acts as an agent for the suppliers, and does not control the operations of such suppliers, you agree Tonic Travels is not liable for any personal injury or property damage, which may arise out of these services and/or your travels. Tonic Travels hereby disclaims any liability whether based on contract, tort, strict liability or otherwise, including without limitation, liability for any direct, punitive, special consequential, incidental or indirect damages, in connection with the services provided by any supplier booking through Tonic Travels’ office or through this website, including without limitation liability for any act, error, omission, injury, loss, accident, delay or irregularity which may be incurred through the fault, negligence, willful acts, omissions or otherwise of such supplier, or of any supplier or their respective employees, agents, servants, or representatives, including, without limitation, their failure to deliver or their partial or inadequate delivery of services and other matters outside of Tonic Travels control, and you hereby release Tonic Travels from any liability with respect thereto.
You agree and understand that any recovery from Tonic Travels will be limited to the commission and fees paid by you and actually received by Tonic Travels in the past twelve months prior to the action giving rise to the liability.
The suppliers providing transportation, sightseeing arrangements, tours, shore excursions, and hotel/cruise accommodations are independent contractors and are not agents, affiliates, representatives or employees of Tonic Travels, or any of its subsidiaries, related companies, or parents. Tonic Travels has no ownership interest in any Supplier. Any use of the Tonic Travels name by a Supplier is for identification purposes only and does not constitute ownership, agency, supervision, or control by Tonic Travels. All documentation, receipts and tickets are issued subject to the terms and conditions specified by the Supplier. By utilizing the services of the Suppliers, you agree that Tonic Travels nor its employees shall be liable for (1) any accident, loss, injury or damage to you or to those traveling with you in connection with any accommodations, transportation, or other services (2) loss or damage to property or injury to persons, caused by reason of any act or omission, intentional, negligent or otherwise by such third party Suppliers. For any service issue disputes, please contact one of our offices by phone or in writing within 30 days of your return. We will do everything in our power to resolve these issues.
Governing Law
These Terms and Conditions will be governed by and interpreted pursuant to the laws of the State of Washington, notwithstanding any conflicts of law. You specifically consent to personal jurisdiction in Washington in connection with any dispute between you and us. You agree that the exclusive venue for any dispute between the parties arising out of or relating to Tonic Travels or these Terms and Conditions will be in the state and federal courts in King County, Washington; provided that Tonic Travels may elect to bring an action against you in any applicable jurisdiction if you fail to submit to jurisdiction and venue in King County, Washington, or to enforce any award or order. You irrevocably waive any rights to bring or participate in any class action related in any way hereto. If any part of these Terms and Conditions is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity or enforceability of the remaining provisions. These Terms and Conditions constitute the entire agreement relating to this subject matter. We may revise these Terms and Conditions at any time.
